• Eligibility to Use

iii. That in the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address or any other wrong information) any extra cost incurred by www.awww.co.in for redelivery shall be claimed from you and you shall pay such cost.

• INDEMNITY
You agree to defend, indemnify and hold Awww, its employees, directors, officers, agents, co-branders or partners, representatives and their successors and assigns harmless from and against any and all claims, liabilities, damages, losses, costs and expenses, (including attorney’s fees and disbursements), caused by or arising out of claims based upon (i) Your actions or inactions on behalf of Awww ’s third party affiliates, manufacturers, vendors, suppliers and logistic partners in providing services; (ii) Your access to or use of the Services or Products, (ii) violation of the Agreement, (iii) infringement, or infringement by any other user of your account with Awww.
Awww shall notify you promptly of such claim, loss, liability, or demand, and in addition to your foregoing obligations, you agree to provide Awww with reasonable assistance, at your expense, in defending any such claim, loss, liability, damage or cost.
• TERMINATION
This User Agreement is effective unless and until terminated by either you or www.awww.co.in. You may terminate this User Agreement at any time by informing us in writing through Indian postal system by registered post that you no longer wish to be associated with this website, provided that you discontinue any further use of this Website.
www.awww.co.in may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Website. Such termination will be without any liability to www.awww.co.in. Any such termination of the User Agreement shall not cancel your obligation to pay for the product already ordered from the Website or affect any liability that may have arisen under the User Agreement.
• LIMITATION OF LIABILITY AND DISCLAIMERS

ADDITIONALLY, IN NO EVENT WILL UP ABOVE ONLINE RETAIL (“AWWW”) OR ITS AFFILIATES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY LOSS OF USE, LOSS OF PROFITS, LOSS OF DATA, COST OF PROCUREMENT OF SUBSTITUTE SERVICES, OR ANY OTHER SUCH DAMAGES, HOWSOEVER CAUSED, AND ON ANY THEORY OF LIABILITY, WHETHER FOR BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), OR OTHERWISE RESULTING FROM (1) THE USE OF, OR THE INABILITY TO USE, WWW.AWWW.CO.IN; (2) THE COST OF PROCUREMENT OF SUBSTITUTE SERVICES, ITEMS, OR WEB SITES; (3) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (4) THE STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE WEB SITE; OR (5) ANY OTHER MATTER RELATING TO THE WWW.AWWW.CO.IN. UP ABOVE ONLINE RETAIL (“AWWW”) GIVES OUT CONTENT RELATED TO A SENSITIVE AND PERSONAL EXPERIENCE OF PREGNANCY BUT AT NO POINT IS AWWW RESPONSIBLE FOR AN UNFORTUNATE OUTCOME OF ANY PREGNANCY CAUSE NATURALLY OR DUE TO AN ATTEMPT OF TRYING ANY PRODUCT OR SERVICE THAT WAS PURCHASED THROUGH AWWW OR ANY OF ITS PROMOTED PARTNERS.
• PRIVACY POLICY

• GOVERNING LAW AND JURISDICTION
This User Agreement shall be construed in accordance with the applicable laws of India. The Courts at Mumbai shall have exclusive jurisdiction in any proceedings arising out of this agreement.
Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by Awww and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held in Mumbai. The High Court of judicature at Mumbai alone shall have the jurisdiction and the Laws of India shall apply.
• MODIFICATION OF TERMS AND CONDITIONS OF SERVICE
www.awww.co.in may at any time modify the User Agreement without any prior notification to you. You can access the latest version of the User Agreement at any given time on www.awww.co.in. You should regularly review the User Agreement on www.awww.co.in. In the event the modified User Agreement is not acceptable to you, you should discontinue using the service. However, if you continue to use the service you shall be deemed to have agreed to accept and abide by the modified User Agreement.
